These Terms & Conditions ("Terms") govern your use of the Eterna Films website and the photography and videography services we provide. By booking a service, submitting an inquiry, or using this website, you agree to the terms below. If you don't agree with any part of these Terms, please contact us before booking so we can address your questions.

By accessing this website, submitting an inquiry, or entering into a service agreement with Eterna Films, you agree to be bound by these Terms & Conditions, together with our Privacy Policy. These Terms apply to all visitors, clients, and users of our website and services.
Eterna Films provides cinematic photography and videography services for weddings, elopements, engagements, family and milestone events, formal and cultural ceremonies, and corporate occasions in Ottawa and the surrounding region. The specific scope of services, coverage hours, deliverables, and pricing for your event are outlined in your individual service agreement, which takes precedence over the general descriptions on this website.
A signed service agreement and non-refundable retainer (deposit) are required to reserve your date. Your date is not considered booked or held until both the signed agreement and retainer have been received. The remaining balance is due according to the payment schedule outlined in your agreement, typically prior to your event date. Late payments may result in delayed delivery of final files.
We understand that plans change. If you need to cancel or reschedule your event, please notify us as soon as possible. Retainers are non-refundable, as they reserve your date and represent time turned away from other clients. Rescheduled dates are subject to availability and may be accommodated at our discretion without an additional retainer, provided sufficient notice is given. Full cancellation and rescheduling terms are detailed in your individual service agreement.
Eterna Films retains full copyright ownership of all photographs and video footage captured, in accordance with Canadian copyright law. Clients receive a personal-use license to download, print, and share their delivered images and films for personal, non-commercial purposes. Unless otherwise agreed in writing, Eterna Films retains the right to use images and footage from your event for portfolio, marketing, website, social media, and promotional purposes. Clients who prefer to opt out of portfolio use should notify us in writing prior to their event.
To help us deliver the best possible coverage, clients are responsible for providing accurate event details and timelines, obtaining any venue permissions required for photography or videography equipment, communicating special requests or must-have shots in advance, and ensuring a safe working environment for our team on-site. Eterna Films is not responsible for missed moments resulting from inaccurate scheduling information, venue restrictions, or circumstances outside our control.
While we take extensive precautions — including backup equipment and, where applicable, second shooters — to protect your coverage, Eterna Films' total liability for any claim relating to our services is limited to the amount paid for those services. We are not liable for indirect, incidental, or consequential damages. In the rare event of equipment failure, data loss, or an inability to perform services due to illness, accident, or other circumstances beyond our reasonable control, our liability is limited to a refund of fees paid for the affected portion of service.
Eterna Films is not liable for any failure or delay in performing our services due to circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather, public health emergencies, government restrictions, or other events of force majeure. In such cases, we will work with clients in good faith to reschedule services where possible.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Ontario.
We may revise these Terms & Conditions from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms. Terms specific to your individual booking are governed by your signed service agreement.
